  • You fought hard for your verdict — don’t risk losing it on appeal. Many personal injury and medical malpractice retainers exclude appellate work, and for good reason. But that gap leaves a dangerous opening: without experienced appellate counsel, your win can vanish in the Appellate Division.


  •  Most trial attorneys are not aware that injured clients are permitted to retain appellate counsel under a separate appellate retainer agreement without touching your contingency fee,  as held in Albunio v. City of New York, 23 NY3d 65 (2014), and Stewart v. NYCTA, 124 AD3d 129 (1st Dept. 2014).  My fee comes only from the client’s recovery — your fee stays exactly as it is.

With 25 Years of experience, Mr. Gorman has successfully secured substantial awards on appeal that might otherwise have been lost. In Martinez v. Premium Laundry Corp., 181 AD3d 439 (1st Dept 2020), he obtained a $3 million award for 39 minutes of conscious suffering. In Redish v. Adler, 195 AD3d 452 (1st Dept 2021), he secured a $10 million award for past and future pain and suffering in a medical malpractice case involving a brain injury.

  • Kenneth J. Gorman graduated from Brooklyn Law School in 2000, where he was a member of the Brooklyn Law Review. After graduation, he served as a senior appellate court attorney for the New York State Supreme Court, Appellate Division, Second Department — the busiest appellate court in the country, overseeing a region that is home to more than half of New York State's population.  


  • This insider experience as an appellate court attorney at the Appellate Division provides invaluable insight into how appellate courts analyze cases and craft decisions. After leaving the court system, Mr. Gorman entered private practice, where he has successfully argued numerous cases involving multi-million-dollar verdicts.


  • Mr. Gorman is admitted to practice before the United States Supreme Court, the United States Second Circuit Court of Appeals, the United States Third Circuit Court of Appeals, the U.S. District Court for the Eastern and Southern Districts of New York, and all New York State courts.
